The bailor can also demand specific performance from the bailee, such as repairing or replacing defective goods.
The bailor has the right to recover possession of the goods if the bailee fails to fulfill their obligations.
Duties of a Bailor:
To pay the principal amount promptly and in full.
To deliver the goods to the buyer in good condition.
To provide the buyer with a reasonable opportunity to inspect the goods before payment.
To fulfill any specific performance obligations agreed upon.
To cooperate with the buyer and the courts in resolving any disputes that may arise.
Rights of a Bailee:
The bailee has the right to receive payment from the buyer for the goods supplied.
The bailee has the right to be paid interest on the principal amount.
The bailee can sue the buyer for breach of contract if the buyer fails to fulfill their obligations.
Duties of a Bailee:
To deliver the goods to the buyer in good condition.
To provide the buyer with a reasonable opportunity to inspect the goods before payment.
To keep the goods in good condition and provide them with necessary care.
To pay the buyer the principal amount and interest on the due date.
