A trademark infringement lawsuit arises when a business uses a trademark that is similar to, or identical to, an existing trademark in a way that is likely to cause confusion among consumers. Dilution
Dilution is the gradual process by which a trademark's significance and reputation are diminished through use of a similar but unrelated trademark. This can happen when the competing trademark is used in a way that is similar to the original trademark, but the competing trademark is used in a different context or with a different meaning. For example, using a mark that resembles the shape of a well-known trademark for clothing can dilute the original trademark's meaning.
The Doctrine of Dilution
The doctrine of dilution states that a trademark that is similar to, but not identical to, an existing trademark can still infringe that trademark if it has acquired a similar level of reputation and goodwill. This means that the competing trademark can still be considered to be confusingly similar to the original trademark, even if the competing trademark is not identical in every detail.
